A statutory declaration is a written statement you solemnly declare to be true, used outside of court. Insurers, employers, pension plans, registries and government programs ask for them when they need you to confirm something formally, and they must be declared before a commissioner for oaths.

Federal and provincial forms

Some declarations are made under federal law and some under Alberta law. The form usually says which. Either way, bring it completed and unsigned, and we will take your declaration.

Declarations going outside Alberta

If the organization that asked for your declaration is outside Alberta, or asks for it to be “notarized,” it should be made before a notary public. We will tell you which applies when you book.

What is the difference between a statutory declaration and an affidavit?

An affidavit is sworn evidence, usually for court. A statutory declaration is a solemn statement for purposes outside court, such as insurance, pensions or applications.

Can two people declare on the same form?

Yes, if the form is set up for joint declarants, such as a common-law declaration. Both people must attend with their own ID.

Is a statutory declaration legally binding?

Yes. Knowingly making a false declaration is an offence, which is why organizations accept them as formal confirmation.

I don’t have a form. Can I still make a declaration?

Many organizations provide their own form. If yours did not, ask them whether a general statutory declaration is acceptable and what it needs to say.
